A couple of thoughts to consider....
In most law essay questions, you will want to:
*Use every fact. Doesn't mean you have to write about every fact, but most every fact is there because it's relevant and helps to prove or disprove some piece of the puzzle. (Not always, though. Beware of the red herring, especially if your Prof is known for writing exams that test you on your ability to sort relevant from irrelevant facts.)
*Use correct terminology. Use precise terminology. Don’t say consideration is “the glue that
holds the deal together.” You might remember what consideration is by thinking of it that way, to help you understand the big picture, but that's not a precise legal definition by any stretch. (Use your law dictionary!)
*Say WHY. Explain your reasoning, step by step. Do not assume anything. (Do not, for instance, say "intent to kill is clear from the facts. Spell out why the defendant's use of a gun, and the manner in which that gun was used, coupled with any other relevant facts, allow for the inference that the defendant possessed the intent to kill.
*Don't launch into conclusions before thoroughly analyzing each step involved in the cause of action or defense theory at issue.
*Don’t write in an exam that you "Ran out of time.”
*Do not write in the first person. It does not matter generally in exams what you believe, what you feel,or what you think. It matters what particular pieces of evidence prove or tend to prove --and why!
